FREE OLIVE GARDEN!

Did you eat at Olive Garden and pay with plastic a couple of years ago? If so, the restaurant chain may owe you a free appetizer.

 Olive Garden could be the latest restaurant to fork over payment — in the form of $9 appetizer vouchers — in settling a federal lawsuit over credit-card privacy.

The deal already has received preliminary approval in the Northern District of Illinois, with a final hearing set for July. It stems from a lawsuit in 2007 that accused Olive Garden of printing the last six digits of customers’ credit-card numbers on receipts. The limit under the Fair and Accurate Credit Transactions Act is five.

Already, several thousand people have submitted voucher claims, said Chicago attorney Thomas Zimmerman, who represented the plaintiffs in the class-action lawsuit against the chain, part of Orlando-based Darden Restaurants. Zimmerman maintains that the glitch put patrons at risk of identity theft. But he could not cite anyone whose identity was stolen.

This requirement to truncate the credit card numbers was widely publicized and was well known for years and the merchants had three years to comply before the law went into effect,” said Zimmerman, who files class-action lawsuits on a variety of claims. “We don’t know why the Olive Garden failed to comply.”

The chain said in a statement that “Olive Garden takes its guests’ data and its legal obligations very seriously.” The statement said the problem was caused by a vendor, and that problematic slips “were provided only to the individual Olive Garden guests. Unfortunately, this mistake initially went unnoticed, but the problem was promptly remedied when it was brought to our attention. There is no indication that anyone has been harmed in any way by this error.”

Diners who used debit or credit cards between Dec. 4, 2006, and Aug. 10, 2007, are eligible for vouchers.

The 2003 Fair and Accurate Credit Transactions Act covers a range of issues, such as mandating annual free credit reports for anyone who wants them. It also puts limits on how much debit- or credit-card information can be printed on receipts. Those limits went into effect in December 2006.

When restaurants and other establishments have printed more than the limits, lawsuits have arisen.

“It is something where both very large and seemingly sophisticated and small and unsophisticated businesses both get caught,” said Walter Olson, a senior fellow at the Manhattan Institute, who has a blog called Overlawyered.

Critics of such suits describe them as opportunistic, pointing out that no one generally reports any identity theft as a result of the breaches.

“It’s like reckless driving in which no one had an accident and except for the lawyers, no one even noticed the car speeding,” Olson said.

The lead plaintiff in the case was Mary Dudzienski of Illinois. Records show that Zimmerman represented Dudzienski in three other similar lawsuits. “A friend of hers had her identity stolen, so that’s what made her interested in these types of cases,” Zimmerman said.

Dudzienski could not be reached for comment.

According to the notice on Zimmerman’s Web site, Dudzienski will be applying for an “incentive award” of $2,500, which Darden has agreed to pay separately. Under the proposal, according to the notice, the company also has agreed to pay about $130,000 to Zimmerman and $5,000 to charity.

Customers who ate at an Olive Garden in the United States and paid with a debit or credit card between Dec. 4, 2006 and Aug. 10, 2007, can fill out a form available at www.attorneyzim.com requesting a voucher. The PDF form is available under the heading “Class Action Notices.” You can also call 1-866-890-4862. You don’t have to provide proof of purchase but do have to sign a document certifying, under penalty of perjury, that you made the purchase. The voucher forms must be postmarked by June 4.

Relapse? More like Collapse

So everybody is talking about it, everybody is bootlegging it, and everybody seems to have a different opinion on Marshall Mathers latest LP, Relapse, and it doesn’t even hit stores till this Tuesday.

My thoughts on the album? I think my graphic above says it all, FAIL. What a flop, and this is coming from the guy who actually LIKED Encore so don’t think I am just Em biased or just hating cause everybody else is liking it (which I’ve actually heard more negative reviews from people than I have positive anyway).

The problem? Well, pick one.

1. Eminem is 37 years old.

Now, with that being said, I am not saying he is too old to be rapping because Jay-Z is damn near 40 and still puts out decent material (see: American Gangster). What I am saying is that Eminem, at 37, should be rapping about NEW things. You’ve been out of the game for what, 4-5 years? You couldn’t think of ANYTHING else to rhyme about besides the same, tired, not-shocking-anymore-cause-it’s-not-1999 bullshit? WE KNOW DUDE, WE GET IT. Your Mom is a crazy bitch, you eat & sleep pills, and you like either getting raped, or doing the raping. Trust me Marshall, we all know, and we all closed our wide open shocked mouths years ago.

Now I know in defense people might come at me and say “dLux, it’s not like the rappers you listen to are actually switching their style up and talking about more things than flipping birds, cars, and smoking weed”

And to that I say touche my friend. BUT, those rappers (Gucci Mane, Shawty Lo, Yung LA, etc) haven’t put out albums that will go down as classics, sold 35 million records, or made more money in rap than most people in the game in a 5 year span. There is no shame in throwing in the towel while you are ahead. Instead, Eminem chose to put out the garbage that is Relapse.

2. Why are you rapping like a cartoon character?

Did I miss something on this album? Is it suppose to be a concept album of a bunch of characters? Or has Slim Shady turned into an arab-rapper and I just missed the bus? “We Made You”? Wigger, please.

 3. Since when has Eminem had to release 3 singles BEFORE his album came out to garner some type of hype? (Go ahead, I’ll give you a second to think about it)

 It all started with that piece of shit that still stinks from here, “Crack a Bottle”. Could you be anymore cliche after a 4 year hiatus? Since when does Eminem take the Cash Money Records circa 1999 route and make a song about popping bottles in the club? Then have 50 Cent jump on the mic and use it as a toilet after Eminem wasn’t even done whiping his own ass? Bad move no. 1 Jimmy Iovine.

OK, so “Crack a Bottle” isn’t gaining much attention, what now? Well, let’s check the toilet out and see if there are any fresh turds left….

YES! FOUND ONE! CORN & PEANUTS INSIDE IT TOO!

“We Made You”

So I gave “Crack a Bottle” a pardon because there were rumors that it might end up as 50′s first single for his upcoming album (it ended up on Relapse in the end) so I figured it was just a bad Eminem chorus/verse.

Enter “We Made You” aka “The Real Slim Shady” aka “Just Lose It” aka the comedic top 40 single. This song is the reason for me saying what’s the deal with the cartoon character voice? Is this dude serious? Is mainstream America serious for actually making this song somewhat of a hit (#1 on iTunes the day after its release)? Absolute garbage and probably holds the title for the worst song on the album right next to “Crack a Bottle”. And the video? MORE SHOCK VALUE!! LOOK AT EMINEM, HE’S CRAZY!!! HE’S DRESSING UP LIKE CELEBRITIES AND BASHING THEM!! CRAZY!!!!!

Obviously “We Made You” wasn’t gaining THAT much steam because Interscope decided to drop ANOTHER single and ANOTHER video (we’re on #3 now, PRE-release). What can we do to make this video different? Hm, let’s take 5.

I got it! We’ll make it like a horror film! And debut the video on Cinemax!! YES.

Enter “3am” (also the name of a Young Jeezy song, produced by Timbaland, which is WAY better, look it up, it’s actually on my first mixtape so you don’t have to look far).

My question on this song is hooowwww muuuchhhh tiiimmmeee stttrreeccttthhiiinggg cccaaannn yyoouuu ddoooo? It is just me or does it sound like he is purposely rapping slower than it should be so he can stay on beat? FAIL.

Now don’t get me wrong here, the album has A COUPLE good songs but it definetly has much more bad than good. I like “Stay Wide Awake” and “Trouble” but that’s honestly about it.

So in conclusion, this album is absolute garbage and I can only imagine that Relapse 2, which is scheduled to come out at the end of this year, will be just as bad if not worse.

If you want some REAL HIP-HOP from some real MCs who’ve been in the game 15+ years and are still putting out quality, then this is the only album you should buy on May 19th:

ROLL IN, ROCK OUT OF BUSINESS

A very reliable source has informed me that MetroWest’s newest nightclub, Roll Bar, has shut its doors indefinetly. Rumors are that the club wasn’t paying its bills and had to fold due to overwhelming debt.

 

Roll Bar recently fired their GM to bring in another person to hopefully breathe new life into their club which, in my opinion wasn’t that bad of a spot. They had the right idea, the right location, and it seemed like they had a steady following but I guess it just wasn’t enough to compete. Investors have apparently gutted the building taking everything they can. Televisions, VIP furniture, and of course plenty of booze were all seized by investors. Rumor has it that the owners of the highly successful Tavern On The Lake, which is also in the same plaza as Roll Bar, are trying to buy the now defunct club.

These guys are insane, and even though they are without Luke, who was really the front man of 2 Live Crew for years, Fresh Kid Ice, Mr. Mixx, and Brother Marquis still hold it down. If you don’t know, 2 Live Crew caused considerable controversy with the sexual themes in their work, particularly on their 1989 album As Nasty As They Wanna Be. These guys basically started the Miami bass sound and reunited with Magic Mike, this is guaranteed to be a crazy night!

 Ok so first things first, DEFAME: Orlando is apparently not Homer Simpson.

Who would have thought, right?

The writer of the now infamous Orlando blog has to decided to call it quits after just over a year. Who can forget the Kanye Shutter Glasses post? How about Orange County Concepts first time making it?

You cannot even mention the blog without saying two words: Saturday/Thursday. The blog provided the platform for no matter what the topic of the post was, for people to express how they felt about longtime Saturday/Thursday DJ Pauly Crush not running the highly successful weekly anymore, most with complete and utter discontent.

What I found so funny and intriguing about the blog is what once was so embarrassing about getting ‘defamed’ turned into what seemed to be a promotional giant whether good or bad. Some people couldn’t look at it as open minded and would have their posts taken down justin james.

If you followed the saga you would know that DJ Docta Dawe himself at the height of the blogs popularity dropped a bombshell on the downtown nightlife scene by not only revealing the identity of the blogger, but backing it up with proof of IP addresses matching up among other things on OCC.

Tempers flaired, in what was to become the most commented blog in OCC history. People saying that we have revealed the wrong person, or that there are multiple people who write for the blog so we would never really know the true identity of the person/persons. What people don’t know is that Meghan actually contacted Dawe through the Defame MySpace and asked him to take that blog down but Dawe said he would only do it under the condition that they finally reveal themselves and not over MySpace or IM, but over the phone. Dawes phone rings and what does he hear? “It’s Megan, I’m Defame”. So Dawe re-worded the blog to not spoil the fun that she was having and keep the mystery alive.

In due time this little blog talking and trashing about all things nightlife in Downtown Orlando would become voted the #1 blog by the Orlando Weekly (OCC got #3) and would eventually end up getting a cover story in the Weekly as well.

After “re-editing” the post revealing her, Dawe and Meghan would actually became good friends and I myself also had the pleasure of meeting and hanging out with the illutrious writer of the blog that captivated a town for months (although her friends are a different, bitchy story).

So in conclusion we here at OCC would like to thank and congratulate Meghan for a job well done. No matter how many of our nights you bashed, put car-bed-Dawe-face on pictures, we always took it in stride and never personal and knew that if people were talking about us, we were obviously doing something right.

History repeats itself twice in 24 hours.

The two things we have been following in the local Orlando news here at OCC have repeated themselves. Two stories repeated, twenty four hours.

Shannon Burke, local radio host was arrested again around Wednesday night for a violation of his pre-trial release. A judge placed Burke on a GPS monitor, which he apparently removed later, and told him he could have no contact with his wife, nor return to home. So Mr. Burke gave a friend his house key and told him to get his motorcycle and gather some of his belongings. That is considered third party contact, and that is something a judge says Burke was not permitted to do. To top it all off, the dog that was injured by Burke’s bullet was also injured again in the commotion last night. wtf.

For the second time in less than one day Orlando police were involved in a shooting. This time, a 17-year-old male was shot in crime hills while fleeing police who saw him carrying a gun. The good news about this one is the kid is going to be ok, the police officer only shot him one time, right in the ASS. haha.

Now back to some fun. Antigua has recovered from the cinco de mayo fiasco and is opened tonight! We do a little party there every week called STEREO. Don’t miss it! Cinco De Crazy!!

So last night thousands of people were out on the town celebrating Cinco De Mayo. Our very own DJ dLux was seen around town looking something like this:

One can only hope last nights parties were as good as the notorious “Scoop de mayo”, which was last years captivating party held at everyone’s favorite UCF area bar “Knightly Scoop”. If you don’t remember last years chaos let me refresh your memory about this hugely successful event:

As you can see maneuvering through last years massive crowd was borderline hazardous. No word yet on how successful “scoop de homo” **cough** “scoop de mayo” was this year…

In other related cinco de mayo news, some nutcase decided to go “cinco de psycho” last night on Church St. I guess he couldn’t take all the Mexican madness that was overtaking the city.

“Barb Jones with Orlando Police says a “man went nuts” on Church Street just as the clubs were letting out, slamming his car first into a parked car, then the Antigua nightclub, and finally some pedestrians. “At some point, officers engaged that driver. Shots were fired by the officers, and the driver of the vehicle was transported to ORMC. I do not have an update on his status.”

 We believe 3 OPD officers opened fire, all have been placed on administrative leave while the FDLE investigates. None of the pedestrians were hurt seriously, but we are not expecting the suspect to survive. In fact, homicide detectives from OPD have been working this scene since the early morning hours. What is most unclear initially is why this man went on that rampage.”

Thanks to WDBO for that story. Word was later that this guy didn’t make it. I can already hear the cries of excessive force by the officers in this case, although it does seem a little extreme to swiss cheese up some guy who was probably drunk and acting a fool on cinco de mayo. I wasn’t there so I obviously don’t know the details first hand, but I have a feeling this story is just beginning. Anyways, all this excitement makes me happy I went cinco de sleepo early last night.

In related news, the MASSIVE GLOW PARTY  Thursday, May 14th @ Antigua won’t be disrupted by the damage caused by the “man who went nuts”.

One final note… Following up on the Shannon Burke story, Orlando radio host Shannon Burke is now out of the Seminole County Jail. According to the Orlando Sentinel, Burke, 43, was released from jail Tuesday and is wearing a monitoring device. He was also fired earlier in the week from his job at WTKS, Real Radio 104.1 FM. Isn’t this the type of thing that would increase their ratings!??! Shannon Burke was arrested, and accused of shooting his dog and wife. He claims it was a mistake, and it seems pretty obvious of that by listening to the 911 call (see below blog for 911 call audio).

Steve Aoki is bigger than Jesus.

The facebook and twitter is buzzing today about last nights Steve Aoki performance at Icon. If you are not familiar with Steve Aoki (kill yourself), He is a HUGE club DJ from California with a massive following. He is also the founder of Dim Mak Records, which jump-started the career of Bloc Party, among others. His sister is model Devon Aoki and father was the founder of the Benihana restaurant chain. He also took my shirt off once.

Good times.

 His stage presences as a DJ is larger than life, jumping all over the stage, diving into the crowd, and nearly causing a riot during his performances. This guy knows how to work a crowd like none other!

With all the hype surrounding this guy, nearly every influential artist and DJ in Orlando was at Icon last night to see what the deal was. Last night was Aoki’s third Orlando appearance, (twice at Saturday/Thursday @ Firestone, once original S/T, once the second coming of S/T). For many of these people, last night was the first time they have seen this guy in action and the reviews were very mixed. The debate has been raging on our very own DJ dLux’s facebook page, where he basically said he was not feeling Aoki’s set. I also spoke with a few other very well respected local DJs who were not impressed by his track selection, or mixing. Were they just hating because they were jealous? On the other hand, a lot of people had been commenting that they enjoyed his set and had a great time. What do you think?

I missed Aoki, because I had to play my own set at STEREO, but in my opinion the star of the night, from what I saw, was the opening DJ Pauly Crush, real talk. That guy opened up with a long methodical track, with no backbeat… just a really epic opening track, then he jumped up on the turntable setup, and yelled out to the crowd, and out of nowhere this bass heavy thumping electro beat came in… and the building erupted just as the huge bright flood lights shined on the big crowd in a frenzy of fist pumps. I’m just calling it how I saw it, like it or not, and that was truly an epic moment….

Now onto a totally different topic…

What the fuck is going on with Orlando radio?!? Not that anyone listens to FM radio anymore anyways, but Clear Channel Communications laid off hundreds of employees across the company on Tuesday, including on on-air talent. The local talent was, Oddo from The Philips Phile on WTKS 104.1, Bubba from The Monsters on WTKS 104.1, Alex Diaz from WXXL 106.7, and Crazy Sam from Rumba 100.3. The ipod/satellite radio have officially won the battle.

On an even more interesting local radio note, well known local radio personality Shannon Burke was arrested this morning for firing a gunshot inside his Altamonte Springs area home that injured a family dog and then grazed his wife in the head!

He was charged with aggravated battery with a deadly weapon and animal cruelty. He is being held without bail in the Seminole County Jail. He told the police that he became angry with the pet late Thursday and was waving a firearm that he thought was not loaded. The bullet passed through the dog’s leg and then grazed his wife. Let’s kick this blog off right and show you how awesome my week has been so far!!

 FUCK YEAH!!

FYI for all my iPhoners, if this happens to you, you have 2 options:

1. Take it to a random tech-savy cell phone repair guy around town and get it fixed for anywhere around $100-$150

2. Get completely fucked in the ass by Apple and have them fix it for $200

I myself chose the second option and don’t get it twisted, they merely replace the screen, you don’t get a new phone even though the new 2 year contract price is $200, the retail price of these phones is $399 and $499. So yeah FML and moving along…

 

THIS GUY is back in town tonight…

That’s right, Kid Millionaire is back in Orlando. If you were lucky enough to catch his set last year then you KNOW this is going be serious. After I saw his set last year he inspired me to not just be a DJ during sets, but to actually be a showman. Aoki doesn’t just play records and watch the crowd react, he reacts WITH you. If you ever caught any of my ‘crunk hour’ sets during the now infamous “Shit Show Saturdays” at (what was) Octagon you can see how he rubbed off on me.

In Billboard chart news…

Rick Ross has the #1 album in the country with Deeper Than Rap selling 158,000 copies in the first week.

Meanwhile DEFAME: Orlando’s new favorite rapper, Asher Roth, sold 62,000 to put him at #5. Pretty much everything else on the charts doesn’t matter.

 

Mixtapes, Mixtapes, Mixtapes….

I already put you guys on to the (fucking amazing) Kid Cudi mixtape last week, well this week we are going back to the trap with Gucci Mane. The Empire, the people responsible for the highly successful ‘Drought is Over’ series with Lil’ Wayne are back at it with GUCCIMANIA (brother).

DJ Smallz, hailing from Tampa, also put out a Gucci Mane mixtape recently with a lot of the same tracks and less talking. DJ Smallz is responsible for what I think is by far one of the best mixtape series ever, Southern Smoke.

Finally!! I have been waiting for DJ Spillz to drop this mixtape for weeks now! If you are not familiar with DJ Spillz he got his start about 12 years ago in Allentown, Pennsylvania playing clubs all over the region. Since then he has moved to Florida, Hawaii, and California, dropping his unique sound and holding down residences. Now he has finally dropped his first open format mix: “That Klub Muzik Sh!t”. This mix is FIRE, check out some of the exclusive DJ Spillz remixes in the mix, his chops, cuts, quick edits, and westcoast swagger are no joke!! This veteran DJs time has come, and he is about to blow!! Remember where you heard him first…

A little side note: If it wasn’t for DJ Spillz, there might not be a DJ Docta Dawe. Spillz was the first DJ I ever met and taught me a lot about the art of turntablism. I learned a lot of my skillz from Spillz!!
