ORANGE COUNTY, Fla. — An East Orange County sports bar was under investigation accused of serving a teenager alcohol before he was killed in a crash.

The Florida Highway Patrol waited on toxicology reports Wednesday to see if 18-year-old Robert Erhart was drunk when he lost control of his car on Curry Ford Road and crashed.

Eyewitnesses said bartenders at TD’s Sports Bar and Grill on University Boulevard served Erhart drinks Friday night. The state division of alcoholic beverages and tobacco has received several complaints about the bar and was investigating them.

The family believes the bar should be held responsible if the allegations are true. “As a parent and teacher I would like to see it shut down,” said the victim’s mother Lea Mack.

Investigators would like to speak with anyone who has knowledge of any underage drinking at TD’s Sports Bar and Grill Friday night.

Okay. There are numerous comments on the WFTV site about this, and everyone is very emotional about this situation. As a long time bartender, and someone in the industry, and someone who has also seen these things go down first-hand, I’ll tell you possibilities.
If they have people checking IDs at the door, and they let someone slide; and the bartender serves that person – the BARTENDER is at fault. Not the person at the door. Yes, they should have been more diligent, but they’re not serving drinks.
If the bartender has to check IDs, or even double checks a door person’s IDs and still serves them (fake id, altered id, torn id, bad id, expired id, wrong type of id…), the BARTENDER is, again, at fault.FAKE IDs, are no excuse. Every bar should have an ID book, and some sort of common sense about FAKE IDs and how to spot them. If you serve someone with a FAKE ID… IT’S YOUR ASS. Once again, IT’S YOUR ASS.
If you showed me an ID with the dates rubbed out, or the ID is peeling and cracked (all 3 illegal for being altered), and I serve you still? My fault.
If the venue does not provide reasonable education on responsible vending, and the bartender is found to contribute to an accident, injury, death, or anything else, THE BARTENDER (once again) and also the BAR can be at fault – if the family was to pursue legal action, they can claim the venue/bar provided no access for reasonable information and education for the staff, something along those lines.
Still, the bartender is the one serving the drinks, and the bartender is the one that will take most of the heat.If the venue provided reasonable education on RESPONSIBLE VENDING, then they can claim they made every effort, and the BARTENDER will be on his/her own.
However, we’ve all seen TD’s crazy drink specials – and over-serving of alcohol is a definite on any given night there. Any time you mix cheap cover with cheap/free drinks, and a lot of young people; it’s a recipe for disaster. I hate to say, but we could all see this coming. 

Bottom line, the door staff (if there is any) will probably get a slap on the wrist, and most likely nothing in the legal system. The bar, if found negligent, will probably get their license suspended, if anything. But the bartender(s) will probably get the full brunt of the storm – fines, jail time, etc.
The legal penalties for underage serving are severe, and any bartender should know them going into any bar position, if not, I feel for you. That alone should make you think twice before sliding that underage person a drink.
Coupled with the fact that the FLABT has already been investigating them, and now this – I would expect a hefty civil suit from the family against the bar, and the bar staff could be in some deep legalese.
(I am not a lawyer, so this should not be taken as legal advice, or the definitive legal course to be followed. This is simply a summation of my past experiences and information I have learned. -A.C)

SAN DIEGO — A mistrial was declared Monday when a home-invasion robbery suspect smeared human feces on his attorney’s face then threw more at the jury.

Weusi McGowan, 37, was upset because San Diego Superior Court Judge Jeffrey Fraser refused to remove Deputy Alternate Public Defender Jeffrey Martin from the case, prosecutor Christopher Lawson said.

At the mid-morning break, McGowan produced a plastic baggie filled with fecal matter and spread it on Martin’s hair and face, then flung the excrement toward the jury box, hitting the briefcase of juror No. 9 but missing the juror himself.

“That juror didn’t even see it coming,” Lawson said.

The prosecutor said the defendant was compliant after the outburst and was taken into custody without further incident.

After lunch, Fraser dismissed the jury, telling them McGowan would have to get a new lawyer and that his trial would be delayed.

The judge scheduled a status conference for Feb. 9 and raised the defendant’s bail from $250,000 to $1 million, finding he is a danger to the community.

Lawson said McGowan originally became upset last week when he claimed one of the jurors saw him in shackles as he entered the courtroom. Fraser dismissed all jurors who saw the defendant in shackles, the prosecutor said.

“The judge had been very fair,” Lawson said. “All jurors who saw it were dismissed.”
Fraser had also denied McGowan’s attempt to represent himself, saying the request was untimely, Lawson said.

The prosecutor said the defendant had previously wiped human feces on himself and was examined by doctors to ensure he was mentally competent to stand trial.

McGowan is charged with kidnapping for robbery, assault with a deadly weapon and other
counts and could face assault charges in connection with the attack on his attorney and jury, Lawson said.

The prosecutor said the defendant hit a man with a rock in a sock as the victim came out of his home to investigate a commotion on Oct. 17, 2007.

McGowan allegedly ransacked the man’s apartment then stole some of the victim’s belongings and took off in the victim’s car.

He was arrested 20 minutes later, Lawson said.

Dear UCF students,
I don’t mind the parking situation. You know which one I’m talking about: the unfair commandeering of parking spots over someone that has was waiting for a spot way before you drove into the lot. I’m okay with this daily occurrence since my patience is usually rewarded with a spot so close I can open my car door and enter the building in one fell swoop.
The object of my frustration is not that nor the fact that there is never a table available in the student union at lunch time. One person to a four person table is ridiculous. We can share, no? I only have an hour between classes, I don’t want to sift through the student union like a white dot in the black half of a yin-yang. But I’m not mad about that.
I’m also not mad about the girls who think brown Ugg boots match an all black outfit. I’m sure you all read Cosmo, but it seems you skim past the fashion section and only read the articles about why he isn’t into you. Ever thought it might be due to your fashion sense? He thinks your boots are ugly, just as much as you think his tractor is sexy.
What this letter is in regards to, what is really pissing me off about UCF students, is that UCF students are the SLOWEST walkers to grace the face of this planet. Usually, I walk around you. I let you know you are walking slowly by passing you with my quick gate. There is one place I cannot pass you, and that is the halls of the Communication building, where all of my classes are. The halls are tiny and you celebrate that fact by talking on your phone and blocking my path. I can’t see your face, so next time I’ll just punch you in the back of the head. I might knock you down with my full backpack. And when you look up to see the bitch that hit you, I’ll throw a SNATCH flyer and a mirror in front of your face so you can see for yourself how much you look like a cunt.
